Tackling Illegal Driving Instructors and Driving Test Backlogs

I recently met with trusted local driving instructor Jules Musgrove from JSM Driving, who shared serious concerns about the growing problem of unregulated and illegal driving instructors operating without the proper qualifications.

At the same time, many constituents have contacted me about the unacceptable difficulty in securing a driving test. Long waiting times and the exploitation of learners through unofficial test bookings are causing huge frustration across Stockport and beyond.

Illegal instruction not only undermines legitimate instructors and businesses, but also risks the safety of learners and damages the integrity of the driving test system. It is vital that enforcement is strengthened to protect both learners and the professional instructors who follow the proper standards and regulations.

I have raised this issue directly with the Government.

During Business Questions in the House of Commons on 5 March 2026, I highlighted concerns about illegal driving instructors operating across the UK. I also raised reports that some individuals are exploiting learners through unofficial driving test bookings and profiteering from driving test appointments.

I also referenced concerns raised by reputable local instructors in Stockport, including Mr Jules Musgrove from JSM Driving, and called for Government time to debate stronger enforcement measures against illegal driving instructors.

Following my intervention, the Minister for Roads and Buses wrote to me acknowledging the risks posed by illegal driving instructors both to road safety and to the reputation of qualified Approved Driving Instructors (ADIs).

In his reply, the Minister confirmed that the DVSA is actively investigating reports of illegal instruction, often working alongside the police, and taking action ranging from warnings through to prosecutions. He also emphasised the importance of reporting suspected illegal instructors and highlighted that there are established processes for doing so.

The Minister also noted that:

  • It is a legal requirement for approved driving instructors to display their ADI certificate or trainee licence while providing paid instruction.

  • DVSA’s Counter Fraud and Investigation team thoroughly investigates allegations of illegal driving instruction.

  • Targeted roadside enforcement checks are carried out, often involving police officers.

  • The Government recognises the vital role qualified driving instructors play in ensuring learners develop the skills needed for a lifetime of safe driving.

Alongside raising these concerns in the House of Commons, I have also submitted a series of Written Parliamentary Questions to press the Government on:

  • What steps are being taken to tackle illegal driving instructors.

  • How public awareness is being increased around the requirement for instructors to be DVSA-approved.

  • Investigations into driving test fraud and the reselling of driving test appointments.

  • Driving test waiting times in Stockport and across Greater Manchester.

  • Measures being taken to reduce waiting times at the Bredbury Driving Test Centre.

  • The overall availability of driving tests in Stockport.

Learner drivers deserve access to safe, professional instruction and a fair, functioning driving test system. Legitimate instructors who work hard to maintain high standards must also be protected from those operating illegally.

I am pleased that the Government has introduced new rules for car driving test bookings, putting learners firmly in control of their own booking. The change means it is now against the law for third parties, including unofficial test booking and cancellation finder services, as well as driving instructors, to make bookings for someone else. These changes came into effect on 12 May 2026.

These new rules put learners back in control by stopping others from snapping up tests and reselling them for profit, helping make the system fairer and ensuring tests go to the people who genuinely need them.

I will continue pressing the Government to strengthen enforcement and address the unacceptable backlog in driving tests affecting learners across our community.
